1. Introduction and acceptance

These Terms of Service ("Terms") govern your use of Racem8 available at racem8.com and the related mobile apps (the "Service"). By creating an account or paying for a subscription you confirm that you have read, understood and agreed to these Terms.

If you do not agree, do not use the Service. The current version is always available on this page; we will notify you of material changes by email at least 30 days in advance.

2. Provider and contact

3. Description of the Service

Racem8 is a SaaS platform for kart-racing telemetry analysis, AI coaching, team management, setup library, and a coach marketplace. Features and limits depend on the tier you choose (Free, Hobby, Pro, Team).

We reserve the right to evolve, modify or discontinue parts of the Service. We will notify you of material limitations of a paid tier at least 30 days in advance.

4. Account and registration

Most features require registration. You agree to:

  • provide accurate and current information,
  • not let third parties use your account (except team-space features, where team members log in with their own accounts),
  • notify us immediately of suspected misuse,
  • if you are under 16, registration requires consent of your legal guardian — dedicated UI is available in the "Parent" section,
  • be responsible for all activity under your account.

We may suspend or terminate the account on violation of these Terms, unpaid subscription or reasonable suspicion of fraud — typically after notice and a cure period.

5. Your data and content

All data you upload to the Service (telemetry, photos, video, notes, setups) remains yours. By granting us a license you allow us solely to process it for the purpose of providing the Service — analyse, store, back up, generate AI insights for you.

We do not use your data to train general AI models, nor do we sell it. Aggregated, anonymised statistics (e.g. "average lap time at Sosnová for X30 Senior") may appear in the product without identifying any specific user.

On account deletion you may export your data as JSON within 30 days. After that we delete it.

6. Acceptable use

You agree not to break the law, abuse the Service for fraud, attempt to bypass security mechanisms, perform automated scraping, inject malware or spam, or infringe third-party rights (copyright in photos, trademarks, etc.).

Violations may lead to account suspension, content removal and, in serious cases, claims for damages.

7. Tiers, trial and payments

The Service has a free tier (Free) and paid tiers (Hobby, Pro, Team). Paid tiers are billed monthly or annually as selected. Payments are processed by Revolut Bank UAB (Revolut Pay, cards, Apple Pay, Google Pay). The price shown for a tier is final for consumers. The company is currently not registered for VAT.

  • Every paid tier (Hobby, Pro, Team) includes a 3-day free trial. We tokenise your payment method at signup but charge nothing during the trial. If you cancel during the trial, we never charge you.
  • If you need a longer trial (e.g. your next track day falls after the weekend), email us at support@racem8.com — we grant trial extensions manually and generously.
  • After the trial ends (day 3) we take the first payment automatically and activate the tier. The subscription then auto-renews at the end of each period until you cancel from your account settings.
  • You may cancel at any time effective at the end of the current billing period; access continues until then. After the paid period ends, the account moves to the Free tier (data is preserved).
  • On a failed renewal we will notify you by email; after 7 days the tier drops to Free. After 90 days of inactivity, the paid licence cannot be restored without a new purchase.

Pricing changes never affect an already paid period. We will notify you of new pricing for the next period at least 30 days in advance; if you disagree you may cancel without penalty.

8. 14-day money-back guarantee (no questions asked, worldwide)

After the first charge (day 3, see section 7) you have 14 days to change your mind. If you decide the Service is not for you, email support@racem8.com and we will refund the full amount. It does not matter how much of the Service you used in the meantime, nor where you live.

This guarantee applies to all users worldwide, not only EU consumers. For EU-resident consumers the statutory right of withdrawal under Czech §1829 of Act 89/2012 and EU Directive 2011/83 also applies — our guarantee is fully compatible with it and in fact goes beyond it (no waiver, no usage conditions).

We will refund within 14 days of receiving the request, by the same method you used to pay (back to card / Revolut / Apple Pay / Google Pay). After day 14 the already-paid period is non-refundable, but you can cancel auto-renewal at any time in your account settings (see section 7) — access continues to the end of the paid period and no further charge is taken.

9. Coach marketplace

Racem8 offers a marketplace where you can find a coach for 1:1 work. Coaches are independent service providers (not employees or sub-contractors of RTE). Racem8 connects you and facilitates payment but is not responsible for the quality, outcome or professional conduct of a coach.

Commission, payouts to coaches and dispute handling are governed by a separate Coach Agreement. If you have a dispute with a coach, you may contact us as the intermediary — we will try to facilitate a fair resolution.

10. Limitation of liability

The Service is provided "as-is". We aim for high uptime and data accuracy, but make no warranties of error-free operation, uninterrupted availability or fitness of AI insights for the real situation on track. No AI recommendation replaces the judgment of the driver or coach.

To the maximum extent permitted by law, our liability to you is capped at the amount you paid for the subscription in the last 12 months. This cap does not apply to intentional misconduct, gross negligence, or personal injury.

We are not liable for damages caused by incorrect kart setup, accidents, lost races, team disputes, or similar events related to kart racing.

11. Termination

You may terminate at any time by cancelling the subscription or deleting the account. The effects are described in section 7 (subscription) and section 5 (data).

We may terminate on material breach by you, repeated non-payment, or upon discontinuation of the Service with 30 days' notice.

12. Force majeure

We are not liable for outages caused by force majeure — internet outages, cloud provider failures (Hetzner, Google, Apple, Revolut), cyber attacks, pandemics, government action.

13. Consumer dispute resolution (EU ODR)

Consumer disputes may be resolved out of court via the EU Commission's ODR platform available at ec.europa.eu/consumers/odr. In the Czech Republic, the Czech Trade Inspection Authority (ČOI) is the competent ADR body for consumer disputes (adr.coi.cz). Our participation in ADR is voluntary.

14. Governing law and jurisdiction

These Terms and any disputes arising from them are governed by Czech law. The competent court is the court of the provider's registered seat (Prague); if you are an EU-resident consumer you may also bring proceedings in the court of your place of residence.

15. Changes to the Terms

We may amend these Terms unilaterally. We will notify you of material changes by email at least 30 days in advance. If you disagree, you may terminate before the changes take effect.
